Mayor Geiben called the meeting to order at 4:30 PM in the Municipal Building on the above date.
RES Claudia Marasco said the Peace Garden in the Village Courtyard has been selected as a BiNational Park between the US and Canada.
She said she and Jackie Lodico are co-chairman of the Peace Garden and they will be replacing the fountain.
She said they went to the artist studio and purchased the fountain and they would like approval to place it in the courtyard.
Trustee Craft asked who will maintain it or replace it if stolen.
Clerk Treasurer Welch said the Village insurance will cover it.
Ms. Marasco said the Village Insurance covers the property and ther volunteers are there daily to care for it.
She said if the fountain malfunctions the artist will be responsible.
She said they will do their best to maintain the gardens and Supt Meigs is aware.
Trustee Craft asked who will repair the fountain.
Trustee Eydt said it is the Village’s responsibility.
Mayor Geiben said they accept the donation of the fountain and the Village will maintain it.
He said they didn’t want to overburden the volunteers.
Trustee Collesano, Eydt and Sutherland agreed.
Mayor Geiben suggested they install a security camera.
FOUNTAIN A motion was made by Trustee Collesano seconded by Trustee Eydt and passed unanimously to accept the donation of the fountain to be installed in the Courtyard Peace Garden.
BILLS A motion was made by Trustee Collesano seconded by Trustee Eydt and passed unanimously to authorize payment of the bills as presented by the Clerk Treasurer for the month of May 2010 as follows:

Mayor Geiben suggested the Board increase the Lewiston Landing Boat Launch fees to pay for a third shift harbormaster.
He said if they increase the daily launch fee from $7 to $10 it may encourage people to buy a season pass.
Trustee Collesano asked the Clerk to check with Youngstown to see what their fees are.
SCH PH A motion was made by Trustee Craft seconded by Trustee Eydt and passed unanimously to schedule a public hearing on Monday June 21, 2010 to increase the Lewiston Landing Boat Launch fees.
Trustee Craft said he met with the Lions Club and he is backing off on the charitable donations collections.
He said they should allow the organizations that have received approval and review any new requests.
DONATION A motion was made by Trustee Craft seconded by Trustee Sutherland to allow the previously approved requests from organizations to collect donations on the streets and review any future requests.
Trustee Collesano asked if Trustee Craft meant to accept the requests they have received but put a moratorium on any new requests this year.
Trustee Eydt said that motion is too vague.
Mayor Geiben said it ties the Board’s hands to approve any new requests, and they should consider requests on their own merit.
Trustee Sutherland said he was confused also.
He said they don’t need a motion.
He said if the Lions don’t want to pursue collections, then the Board should review the requests on a case by case basis.
Trustee Craft said the real issue is collecting on the streets.
Trustee Collesano said the original motion allows the organizations who were already approved.
Mayor Geiben said they should approve the requests individually.
Trustee Craft said they should treat all requests alike.
Trustee Sutherland said he didn’t like the proposed moratorium.
Mayor Geiben said he will vote against any moratorium.
The motion was denied unanimously.
Mayor Geiben said the Village’s Insurance Agent said the people facilitating the project have to have insurance.
Don Luce, Community Missions said they will provide insurance and Heart & Soul will also provide insurance.
Mayor Geiben said he didn’t want the boy scouts in the streets collecting.
Ms. Marasco said she talked to the Scout Leaders and the scouts can walk to the site and do community service on the sidewalk by holding signs or whatever.
Mayor Geiben asked her to let the people know there are collections ahead.
Trustee Collesano said he is satisfied.
Trustee Eydt said he was involved with the Boy Scouts for years and they can help and it makes them part of the community.
He said they will be getting more requests this year for charitable collections.
Trustee Craft said he did not want them going to the residents doors or hawking.
Ms. Marasco said they promised to stay off Center Street.
Trustee Sutherland said he has been there and it is not a noisy operation.
Trustee Eydt said one resident said he felt the collections were not organized but had no objections to it.
Mayor Geiben said he just wanted it managed better.
He said he thought having it inside Artpark would be better, but it got confusing and peoples feelings were hurt.
Ms. Marasco said their group was requesting all Tuesdays.
Trustee Craft said the Lion’s Club will request next year.
Trustee Collesano said he never received any complaints.
DONATION A motion was made by Trustee Sutherland seconded by Trustee Eydt and passed unanimously to approve the request by Claudia Marasco and Mamie Simonson to collect charitable donations on S Fourth & Tuscarora Street and Portage Road east of Seneca Street to benefit Heart & Soul and Community Missions every Tuesday during the Artpark season contingent upon submitting a certificate of insurance from the organizations.
BonaSue said she found this project to be one of project she is most proud of and she invited the people to donate and said the people thank them for the opportunity to give.
HIRE A motion was made by Trustee Collesano seconded by Trustee Sutherland and passed unanimously to hire Brian Ball as a DPW Seasonable worker at $9.50/hr.
PYMT A motion was made by Trustee Sutherland seconded by Trustee Craft and passed unanimously to authorize the purchase of roofing shingles from B& L Wholesale Supply Inc in the amount of $5289.85 from H12-7497.2 for the Piper Law Office

Mayor Geiben called the meeting to order at 6:00 PM in the Municipal Building on the above date.
He announced that Boy Scout Troop #855 was in attendance to acquire a badge in government.
The Boy Scouts led the Pledge of Allegiance.
Mayor Geiben stated that the recent newspaper article stating that Mr. Richard Hastings would like to swap the Frontier House for the Silo Restaurant was not discussed with the Village Board, nor was any proposal submitted.
RES Claudia Marasco asked if they would be discussing the collection of charitable donations.
Mayor Geiben said it was on the agenda under “Discussion”.
Timothy Lockhart gave the Annual Stormwater Report.
He said the Village of Lewiston meets the requirements and has made great strides in inflow and infiltration.
He said the Board needs to pass a resolution
RESO A motion was made by Trustee Eydt seconded by Trustee Craft to adopt the following resolution:
RESOLVED: that the Village Board of Trustees hereby authorizes the Mayor to sign the draft Annual Stormwater Report #7 being held in the Village Clerks Office for public comments until 5/21/2010, and then the draft report will become final and mailed to DEC .

REPORTS Chief Salada reported that the pedestrian crossing sign was stolen.
He said the DPW garage was also vandalized.

He said residents should be aware that they require CO Detectors.
Clerk Treasurer Welch said if Building Inspector Candella gives her the information she will put a notice in the newspaper.
WARRANT A motion was made by Trustee Eydt seconded by Trustee Collesano and passed unanimously to authorize the levy of real property taxes for the fiscal year 2010-2011 Tax Warrant directing the Clerk Treasurer to receive and collect: taxes in the amount of $860,423; a relevy of water and sewer charges in the amount of $76,787.58; a relevy of refuse charges in the amount of $_.00, a total warrant to collect $937,210.58 and to establish the tax rate of $6.24 per thousand.
DEV PLAN A motion was made by Trustee Collesano seconded by Trustee Craft to approve a development plan for portable restrooms at Whirlpool Jet Boat/Water Street Landing, 115 S Water Street, as approved by the HPC/Planning Commission
Trustee Eydt said he attended the HPC/Planning Commission meeting and he explained that the units are temporary and will be removed by Labor Day.
He said the Whirlpool Jet Boat patrons that arrive on buses from Washington DC need the facilities as soon as they arrive and said that some of the patrons have been relieving themselves in the surrounding area outside.
He said the unit will have skirting, and be landscaped and the Porta Unit sign will be removed or covered.
He said the entrance will be on the river side and the unit will be placed between the dumpster and Water Street Landing.
The motion passed unanimously.

Clerk Treasurer Welch said the “grease trap” letters will be going out to the business owners.
Engineer SanGiacomo said he will start the inspections the following week.
Mayor Geiben said they received a request to remove a dying tree in the Village right of way at 920 Onondaga Street and Supt Meigs checked it out.
Supt Meigs said the tree is half on the Village right of way and half on the owners property.
Attorney Grenga said if the tree falls the Village is responsible because they have been put on notice and recommended the Village remove the tree.
TREE A motion was made by Trustee Craft seconded by Trustee Collesano and passed unanimously to remove the tree at 920 Onondaga Street at the Village’s expense.
Clerk Treasurer Welch announced that the Village’s Real Property Taxes will be sent out June 1, 2010 and payable without penalty up to July 1, 2010.
Supt Meigs said he will be finishing the paving within the next two weeks.
Mayor Geiben said they need an easement from Mr. Brochey to access the proposed parking area on the Village right of way at 8th and Center Street.
Attorney Grenga said he will work up an easement agreement.
Trustee Eydt said he thinks the additional parking is a great idea and will give Macri’s Restaurant additional parking which is needed.
EASEMENT A motion was made by Trustee Eydt seconded by Trustee Craft and passed unanimously to authorize the Mayor to sign an easement agreement between the Village of Lewiston and Mr. Brochey to access the additional parking on the Village right of way at 8th and Center Street.
Mayor Geiben asked Claudia Marasco to decide what dates they will need for the charitable donations collections, insurance certificates and specific areas for the collections and submit it to the Village Board.
Claudia Marasco asked if they were covered under the Village’s insurance.
Mayor Geiben said he will contact the Village’s Insurance Company Representative.
Trustee Craft said the Lion’s Club had to have their own insurance.
Ms. Marasco said she still would like the Lion’s Club to be involved and they would like volunteers on Tuesday nights.
Mary Beth Coleman asked if Artpark was going to get a percentage of the collections if they have the collections inside Artpark.
Mayor Geiben said the Board can review it on May 27.
Tom Huisigen, Lions Club member said they submitted a letter regarding the collections in Artpark and they hoped to help the Village.
He said no one will be collecting in the street.
He said it was his understanding that if Artpark gave permission to collect donations in the park that there will be no collections on the street.
Mr. Huisigen said in summation he hopes that the Board sees the needs of the Lions Club and the benefit of collecting inside Artpark.
Mayor Geiben said Claudia Marasco and Mamie Simonson and their volunteers worked diligently last year for the needy and their collections may need some modifications and the Lion’s Club offered their assistance and if they could assure Heart & Soul and the Community Missions success that would be great but if not it could take away from their donations.
Trustee Craft said 3,000 children attend Artpark programs and the 30% of the donations would go toward the children’s programs.
He said he talked to Mrs Simonson and assured her the Lion’s Club could keep the collections going in the future.
He said 10,000 people attend the concerts and have to go past them and most people will donate.
He said the Lion’s Club does not want to collect on the steet because it is a safety hazard.
Trustee craft said he has respect for Ms. Marasco and Mrs. Simonson for all they have accomplished.
Supt Meigs said one of the pedestrian crossing sign was recently damaged.
PED SIGNS Following a brief discussion a motion was made by Trustee Eydt seconded by Trustee Collesano and passed unanimously to purchase two new pedestrian crossing signs.
Trustee Collesano said a sign is needed in front of Apple Granny Restaurant because the delivery trucks stop in the middle of the street and it is dangerous for pedestrians to cross.
He said he will pay for one of the signs for that crosswalk.
Mayor Geiben asked Chief Salada to put the mobile sign at Center and 8th Street asking to watch for pedestrians.

Mayor Geiben called the meeting to order at 6:00 PM in the Municipal Building on the above date.
FAC CONT A motion was made by Trustee Eydt seconded by Trustee Sutherland and passed unanimously to approve a facility contract for the Lewiston Fire Co No 1 to use the Academy Park every Tuesday from May 4 to August 30, 2010 for softball.
PYMT A motion was made by Trustee Craft seconded by Trustee Sutherland and passed unanimously to approve payment of $4175 from H12 to Brian Daddis Masonry for the renovation of the chimney and additional fireplace renovation at the Piper Law Office.
CREDIT A motion was made by Mayor Geiben seconded by Trustee Sutherland and passed unanimously to accept the credit of $1300 from Valery Construction in lieu of landscaping at the Piper Law Office.
EXEC SESS A motion was made by Trustee Craft seconded by Trustee Eydt and passed unanimously to schedule an Executive Session immediately following the meeting to discuss personnel.
Mayor Geiben discussed a list of priorities for upcoming projects that Supt Meigs will be doing.
He said water breaks and maintenance of equipment is always first.
Supt Meigs said he is ready to pave the parking lots and install parking spaces on N. 3rd Street.
He said he could also pave a portion of Village right of way next to Brochey’s Automotive at 800 Center Street.
He said he works with the Town of Lewiston schedule and will be paving the month of May.
He said he has four or five antique lights in the garage to be installed at the waterfront.
Supt Meigs said he also has a pipe job across from the Barton Hill Hotel on N First Street and he has to fix an infiltration leak on Mohawk Street which is a major job, so he doesn’t want to install the sidewalk until after the job is completed.
Mayor Geiben said they are solving the I & I problems by fixing the leaks.
He said to make the project a priority in 2011 and then install the sidewalk.
He said to meet with Engineer SanGiacomo for a plan and time frame.
Trustee Craft told Supt Meigs that the fence at Lewiston Landing needs a third rail so no one can slip under the fence down the embankment.
Supt Meigs said he will take care of it.
Mayor Geiben said they are waiting for Relicensing funds to install new water lines on N Ninth Street.
Supt Meigs said he will be paving Page Ave from 7th to 9th Street, Fairchild, N 2nd from Onondaga to Oneida, Niagara Street from Center to Cayuga, and S 1st from Cayuga to Seneca Street.
He said the parking spaces on N Third Street may freeze in the winter and become hazardous because of the incline.
Mayor Geiben said it is not a high priority.
Mayor Geiben asked Supt Meigs if he has money in the budget to continue re-pointing the brick on the Municipal Building.
Supt Meigs said the Municipal Building needs a new roof and it will cost $33,000.
Mayor Geiben said to put it in the budget in 2011.
He asked Supt Meigs to take down the scrub trees on Ridge Street behind the Frontier House.
He also asked Supt Meigs to check out the N Seventh Street sidewalk.
Supt Meigs said he looked at the sidewalk and he will have to remove two old chestnut trees and stump them and move the sidewalk back from the road.
Mayor Geiben said directly west of Brochey’s (800 Center) parking lot there is a grass village right of way area that could be paved and used for parking.
He said Mr. Brochey would give them an easement to park there and Macri’s and Hibbard’s customers could park there.
He said there should be at least 8 parking spaces.
Trustee Collesano said the increased parking area would benefit both the Village and Brochey’s.
Trustee Eydt said he feels it would be advantageous to the Village to have extra parking.
Trustee Craft said they will need a written agreement.
Attorney Grenga said it could be a revocable easement.
The Board agreed to proceed with the proposed parking.
Mayor Geiben said this is the first time a resident has asked to remove a village tree since the new tree law.
Stan Jablonski explained that he received a variance to construct a new garage but the existing tree is in the way.
He said it has cracked his driveway, heaved the sidewalk and the roots get into his sewer repeatedly and he has to have the sewer line cleaned out.
He said he is investing $30,000 in his property and after removing the tree at his expense, he will plant two new trees.
TREE Following a brief discussion, a motion was made by Mayor Geiben seconded by Trustee Sutherland and passed unanimously to approve the request to remove the village tree at 325 N Fourth Street at the owners expense and contingent upon planting two trees.
Mayor Geiben said the Oddfellows would like to collect donations during the Art Festival.
Trustee Sutherland said they should wait until the other proposal to collect in Artpark is worked out.
A motion was made by Trustee Eydt seconded by Trustee Collesano and passed unanimously to authorize the transfer of $1356.51 from A5182.405 (St Lighting) to A5142.4101 (Sand) due to unanticipated expenditures.
Mayor Geiben said the proposal for a new sign at Academy Park was too expensive so maybe they can just fix the old one.
Engineer SanGiacomo said he had plans for the sign and he will submit them.
Mayor Geiben said the Seneca Street exit to the Parkway will be open for the Artpark Tuesday concerts.
He said this will help alleviate the traffic problems.
Trustee Craft said Artpark needs to advertise it on their website.
Trustee Eydt said the Spring Fling was great and commended Recreation Director Gittermann and said the Village Board members won the Horseshoe Tournament against the Town Board Members.
Trustee Sutherland said the new Hennepin Park sign is installed and he and Supt Meigs are meeting with the “Black Pearl” Captain on Sunday to make sure they are able to dock at Lewiston Landing.
Mayor Geiben said they are moving ahead with the directory sign.
Trustee Collesano said he said farewell to Library Director Ron Shaw who has taken another position in Elmira.
He said Jill Palermo is the new Director.
Engineer SanGiacomo said Attorney Grenga wrote a letter to restaurant owners regarding grease trap requirements.
He said the wording is strong so the owners comply.
He said the inspections are a waste of time if not enforced.
Mayor Geiben said to go ahead with the letters.
He said the owners have had a year to comply.
Mayor Geiben suggested they increase the boat launch fees.

Mayor Geiben called the meeting to order at 5:30 PM in the Municipal Building on the above date.
He congratulated Mamie Simonson for the successful food drive and donations for the Heart & Soul Mission and the City Mission before the Artpark concerts.
He explained that Trustee Craft met with George Osborne, Artpark Director who said they will allow the service organizations inside the park to conduct their food drive and donations for various charities.
Mayor Geiben said he is hopeful it will work out and they can use Artpark’s website and jumbo-tron to ask for donations.
He said they should collect more than last year and the different organizations can split the donations for their charities.
Mrs. Simonson said they would like to collect as much as last year if not better.
Mayor Geiben said Kiwanis and the Fire Company may continue to use Center Street for their drives.
Trustee Graft said if they work it out with Artpark they may get the best spot to solicit.
He said he is trying to make it safer by not collecting on the street.
He said he has talked to the Fire Chief and EMT’s and feels they will do better at the park.
He said people have complained to him that they can’t get through to Artpark because they are collecting donations on the street.
Trustee Craft said the organizations should collect more in the park.
He said the Lion’s Club donates all their proceeds to charity.
He suggested they go to the grocery stores and ask if they can have a food drop off there.
Mrs. Simonson said she is also concerned about safety but they collected thousands of dollars.
She asked that Sister Barbara and the Heart & Soul is given first consideration.
Trustee Craft said he couldn’t promise anything but they will work hard to get as much as they can.
Mayor Geiben asked how much they collected last year.
Mrs Simonson said $5500 for Sister Barbara at the Heart & Soul and $5000 to City Mission.
She asked Trustee Craft why Mr. Osborne has to have 40% of the donations.
Trustee Craft said the Lions Club agreed to give him 40% for his children’s programs.
Claudia Marasco said they collect to feed the people and she said Mr. Osborne told them it was illegal to solicit in the park.
She said 40% is very generous.
She said they give directly to feed the people and Niagara Falls has 4000 people at poverty level.
Ms. Maracso said it is something positive the residents of Lewiston can do and their donations go directly to the table.
Trustee Eydt asked when they collected – every Tuesday?
Ms. Marasco said they asked for every Tuesday and asked why can’t the other organizations collect on Wednesdays.
Trustee Eydt said he understands their mission because his wife works with them.
Trustee Sutherland said the topic should have been discussed at the SOLE meeting.
Mayor Geiben said he thought the Artpark website and the Jumbo-tron would help them.
Trustee Craft said he is concerned about the liability and the safety of the people on the street.
Trustee Collesano said Trustee Craft has a good idea but the other three Board members were unaware of the proposal.
Mayor Geiben said they will advise Claudia after they speak to Mr. Osborne.

Mayor Geiben opened a public hearing at 6:00 PM in the Municipal Building on the above date on the advisability of adopting a local law enacting a new code for the Village of Lewiston, New York; providing for the repeal of certain ordinances not included therein; providing for the manner of amending such code; and providing when such code and this local law shall become effective.
Mayor Geiben explained that the Village Code needed to be revised and after reviewing it and making the necessary changes the code was ready for adoption.
As there were no comments, the public hearing was closed.

REPORTS Recreation Director Gittermann submitted her report and said if anyone has any events in the Village of Lewiston they can email it to her and she will post it on the Village’s website.
Trustee Eydt said he is concerned about the build up of grease in the sewer lines and said they should be inspecting grease traps in the restaurants.
He said the last bill was $3100 to remove the grease from the lines.
Supt Meigs said the bill was double the cost from last year.
Trustee Eydt said it is time for businesses to comply with the grease trap requirements.
Mayor Geiben asked if Supt Meigs could have the DPW do the inspections.
Supt Meigs said he did not have the manpower.

A motion was made by Trustee Eydt seconded by Trustee Sutherland and passed unanimously to adopt a local law enacting a new code for the Village of Lewiston, New York; providing for the repeal of certain ordinances not included therein; providing for the manner of amending such code; and providing when such code and this local law shall become effective. RESO A motion was made by Trustee Sutherland to adopt the following resolution;
RESOLVED: that the Village of Lewiston hereby requests New York State Office of General Services Division of Land Utilization to renew the permit for an Easement of Land dated 6/21/94 for the use of State owned property mile reserve lands and lands under the waters of Niagara River, Village of Lewiston known as Lewiston Landing Extension, as shown on the attached survey.
The resolution passed unanimously with all voting “yes” on the motion.
FAC CONT A motion was made by Trustee Eydt seconded by Trustee Collesano and passed unanimously to approve a facility contract for the Lewiston Library to use the Red Brick Municipal Building Gym for the Friends of the Lewiston Library Annual Book Sale on Friday, August 13, through Sunday, August 15, 2010 with set up August 4-15, 2010.
FAC CONT A motion was made by Trustee Sutherland seconded by Trustee Collesano to approve a facility contract for the Lewiston Kiwanis Club to hold their Annual Block of Dollars on August 14, 2010 at the intersection of Portage Rd and Center St from 8:00 AM to 6:00 PM.
Trustee Craft said the Lions want to work with all the organizations to collect donations together in Artpark.
He said he is concerned about the liability and the safety of the people collecting on the streets.
He said he will treat all requests equally and vote “no” because of the safety factor.
The motion passed with Trustee Craft voting “no”.

FIRE CO A motion was made by Trustee Collesano seconded by Trustee Sutherland and passed unanimously to accept the resignations from Patrick Schmader and Sarah Hartman from the Lewiston Fire Co No 1.
DISC Mayor Geiben said they received a request from a resident who recently received a variance to construct a garage and would like to remove the tree on the village right of way because it is in the way of the driveway and is lifting the sidewalk and clogs his sewer line.
He said the resident said he will remove the existing and plant another tree at their own expense.
Trustee Sutherland asked if Supt Meigs has looked at the tree.
Supt Meigs said there is minimal damage to the sidewalk.
Jill Birmingham said the sidewalk is a tripping hazard.
Justin Birmingham said they can build the garage without removing the tree.
Trustee Craft said they have to be careful of the Village trees because the Village is noted for the trees.
Trustee Eydt said he would like to look at the tree and asked if they can discuss it at the next meeting.
He said they can still start the garage.
Trustee Craft said he didn’t want to set a precedent.
Mayor Geiben said the Village Code gives them the authority to allow the tree to be removed.
Mayor Geiben said the Recreation department would like to have asked built at the west side of the building for storage.
He said the attic is inappropriate for storage.
Trustee Collesano said he did not have a problem with it but it should go through the Historic Preservation/Planning Commission.
Mayor Geiben said the BOCES would build the she and it would save the Village the cost of the labor and also provide the BOCES with a class project.
Supt Meigs said the roof on the Municipal Building is leaking and would like to have Thompson Roofing repair it.
He said it will cost $1800.
Trustee Sutherland asked if Supt Meigs received any other quotes.
Supt Meigs said he did not because Thompson Roofing has done the previous work on the roof.
ROOF A motion was made by Trustee Craft seconded by Trustee Eydt and passed unanimously to authorize Thompson Roofing to repair the Municipal Building roof.
Mayor Geiben announced that May 3 to 7, 2010 is May Clean Up Week, the parking lot between 5th and 6th street is open.
He said he had a verbal agreement with the Town of Lewiston Supervisor to repair/replace the water/sewer lines with the Relicensing funds.
Supt Meigs said they found two more infiltration breaks in the sewer lines at Fairchild and Mohawk Streets.
Trustee Eydt asked when Seneca Street was going to be repaired.
Supt Meigs said by mid May.
Engineer SanGiacomo said he could do the grease trap inspections but he need to meet with the Mayor and Attorney to give him authorization to go into the businesses to make them comply with the requirements.
Mayor Geiben said he will give a letter of introduction to go to the restaurants.
Trustee Collesano said the restoration of the chimney at the Piper Law Office is complete.
He said Valery Contracting will give them a credit for the grading because the dumpster is still in the area.
Trustee Craft said he will meet with Chief Penzotti to see if they can have the Lewiston Fire Company EMT’s in Artpark.
Trustee Eydt said the Recreation Department Spring Fling is on May 2 and he is looking forward to it.
He said the stairways at Lewiston Landing look great and said Bob MacVie did a great job on them.
He said the Board will be challenging the Town Board to a horseshoe tournament during the Spring Fling.
Trustee Sutherland said he and Supt Meigs met with the “Black Pearl” Captain regarding the dock requirements and everything was worked out.
Mayor Geiben said they will also install signage regarding the parking.
He said he is participating in a “Mayors for Meals” and said it is a great program.
He said the Rite Aid Plaza rear parking lot is going to be repaved.
Mayor Geiben said the renovation of the caboose at Lewiston Landing was going well and Mr. Hastings is going to plant two more trees because two existing trees were damaged during the construction.
He said the work session is on May 3, 2010.
He said the Chamber and Lew Port students did an inventory of the businesses for the proposed directory.

Mayor Geiben opened a public hearing on the above date on the advisability of adopting the tentative budget for fiscal year 2010-2011.
Trustee Eydt said they get a percentage of the police fines when the incident happens in the village and they need to keep an eye on the revenues form the tickets.
Mayor Geiben said they have not settled the agreement between the Town of Lewiston and the Village of Lewiston regarding the Police budget, but there is enough in the budget to cover the costs associated with the agreement.
The public hearing was closed at 6:07 PM
Mayor Geiben called the regular meeting to order at 6:08 PM.
RES Claudia Marasco said she would like to address their proposal to hold their Food/Donation drive on Tuesday nights near Artpark.
She said the Board said they would get back to them but she read an article in the Sentinel that the Board decided to have other organizations solicit at the same time with them.
She said the Village Board endorsed them last year and they raised $10,000.
Mamie Simonson asked if they had a meeting and decided to have the Lions Club solicit at the same time as them.
Mayor Geiben said Trustee Craft said the Lions Club is pursuing an agreement with Artpark to have several organizations solicit at the same time so the people are not being solicited all the time in the Village.
He said they did a great job and he wants them to continue to help the City Mission and Food Bank.
Trustee Craft said he discussed it with Ms. Marasco and said that George Osborne, Artpark Director said he will get back to him to let him know if the organizations can solicit in Artpark.
He said the Lions Club donates to all causes.
Ms. Marasco said she thought Mr. Osborne said it is against the law to solicit at Artpark.
Mayor Geiben suggested they meet on Monday, April 19, 2010 at 5:00 PM to further discuss the proposal.
Trustee Craft said as a Village Trustee he has to make sure all organizations are served.
Mayor Geiben said they will all meet and said they want to meet the needs of the community.
Trustee Collesano said the whole Board will meet with them.
Trustee Craft apologized to Mrs. Simonson for not contacting her to let her know about the possibility of other organizations collecting donations as a group.
A motion was made by Trustee Collesano, seconded by Trustee Eydt to adopt the following resolution:
WHEREAS, the Board of Trustees of the Village of Lewiston held a public hearing on April 12, 2010 as specified in the notice of public hearing on the tentative 2010-2011 Budget, and,
WHEREAS, all persons desiring were heard;
NOW, THEREFORE BE IT RESOLVED, that the tentative 2010-2011 budget, and hereinafter set forth in the total amount of $2,931,181 with a tax rate of $6.24 per thousand, is hereby adopted, and that the several amounts stated in the column titled “Board Action” in Schedule 1A, Schedule 1F and Schedule 1G, together with the amount set forth in Schedule 3 as required for the payment of principal and interest on indebtedness, and the new salaries, grades and wages stated in Schedule 5 shall be and hereby fixed at the amounts shown as effective June 1, 2010.

BE IT RESOLVED: that by the Village Board of Trustees of the Village of Lewiston, New York that the General Village Election for the Village of Lewiston, New York in the County of Niagara will be held at the Village of Lewiston Municipal Building, 145 N Fourth Street, Lewiston, NY on Tuesday June 15, 2010 and the polls for said election will be open between the hours of 12:00 noon until 9:00 PM Election Law 15-104 (3).

A motion was made by Trustee Collesano seconded by Trustee Eydt to adopt the following resolution:
RESOLVED: Pursuant to Section 15-116 of the Election Law to appoint Frank Nicolette, Marie Nicolette, Joan Dougherty, and Collette Case as Inspectors of Election for the forthcoming Village Election to be held on Tuesday, June 15, 2010, and to designate Frank Nicolette as Election Chairman, and
FURTHER RESOLVED to appoint Evy Newlin, J. Mosey, Peter MacLaren and Stephanie Myers as Alternative Election Inspectors, who shall assume the Office of Inspector of Election who shall perform duties, and as Election Clerks, and
FURTHER RESOLVED, pursuant to Section 3-420.1 of the Election Law to compensate said Inspectors of Election, Alternate Inspectors and Election Clerks at the hourly rate of $ 7.25, and to compensate the Chairman an extra $10, and
FURTHER RESOLVED, pursuant to Section 3-3-302 of the Election Law to compensate the two Voting Machine Custodians $45 each per voting machine.

Mayor Geiben said the April 14, 2010 budget work session was cancelled.
He announced Earth Day Clean Up is on April 17, 2010 and invited anyone who would like to help in the clean up.

BUDGET MEETING APRIL 8, 2010

Mayor Geiben called the meeting to order at 4:15 PM in the Municipal Building on the above date.
He informed the Board that the Police agreement has expired and gave them copies of the previous agreement to review.
He said they put together a realist budget and added to the fund balance and the contingent account to try and build up the reserves.
Deputy Treasurer/Budget Officer Goodman went over the proposed budget with the Board and said she and Supt Meigs made minor cuts to most of the accounts to maintain the current tax rate.
Mayor Geiben said the Attorney and the Engineer agreed to decrease their salaries also.
He said they will be using Relicensing funds for repairs and replacements of the water/sewer lines.
Trustee Collesano said the $5.00 miscellaneous fee on the water/sewer bill is to be used for the repairs and replacement of the water/sewer lines and he wanted to make sure it was used for that exclusively.
Mayor Geiben said they need to pay the Village share $30,000 for the renovations at the Waste Water Treatment Plant.
He said they will have to bond for the funds.
He said the ISTEA bond is almost paid in full.
Deputy Treasurer/Budget Officer Goodman explained the revenues received in the current fiscal year and said it serves as a guideline for the new budget.
Supt Meigs explained the lease agreements for the new equipment.
He said he also needs to keep a surplus of water/sewer line clamps in case of water/sewer line breaks.
He said Fairchild Place needs paving this year.
Supt Meigs decreased his accounts this year and hopefully there won’t be any unexpected expenditures.
Mayor Geiben said they will review the proposed budget and the public hearing is on Monday, April 12, 2010 at 6:00 PM.

BUDGET Deputy Treasurer/Budget Officer Goodman presented the 2010-2011 Budget.
Mayor Geiben said over the years the Mayor, Karen and Department Heads put together the budget.
He said Deputy Treasurer/Budget Officer Goodman worked diligently on the budget with a 0% tax increase.
He said they still have to meet with the Town Board to renew the Police Agreement but is hopeful the Village share is not increased.
Deputy Treasurer/Budget Officer Goodman went over the budget line by line and explained the reduction of many of the accounts to be able to maintain the current tax rate of $6.24 per thousand.
She said she worked with Supt Meigs on reducing some of his accounts and explained the lease agreements and bond payments and said they are not using any fund balance this year.
She also said the DPW (per contract), Clerk’s Office and Recreation employees received a 3% increase in salaries.
Deputy Treasurer Goodman/Budget Officer Goodman said the Mayor, Trustees, Attorney, Building Inspector, Fire Inspector, Zoning Officer and Boards and Commissions did not receive an increase.
ARTWORK Following a brief discussion, a motion was made by Trustee Sutherland seconded by Trustee Eydt and passed unanimously to authorize the payment of $200 from A7550.415 (Celebrations) to John Scott Pedley for artwork of the Village Clock Tower with the Village of Lewiston key to be used as gifts from the Village.
Mayor Geiben asked the Board members for their input regarding the various fund raisers during the summer months in the Village.
Trustee Craft said he spoke to the Fire Company and will speak to the other groups to see if they will consider having a joint fund raiser.
DELMONTE Assemblywoman Francine DelMonte said she came to the meeting to meet the new Board Members.
Mayor Geiben said it seems like the Member Items are granted to downstate municipalities and the Village of Lewiston would like their share.
Assemblywoman DelMonte said she needs requests in writing before February to be awarded in that year.
The Board discussed several issues with the Assemblywoman and thanked her for her visit.
Mayor Geiben said Emery Simon is still dumping fill on the property at 870 Center Street and asked Supt Meigs to remove the stone left there from the relocated house.
Trustee Collesano said the Arts Council wants to have a fund raising event on Sunday August 15, 2010 during the Art Festival.
Trustee Craft said he would like to have the Lions Club, Fire Company and other organizations work in conjunction with each other.
He said people complain now about too many fund raising events on the street.
He said he will call the Fire Company and suggest they work together.

Mayor Geiben called the meeting to order at 6:00 PM in the Municipal Building on the above date.
RES Claudia Marasco asked the Board if they could solicit food and donations for the City Mission and Heart & Soul.
She said last year they received numerous donations and it was very successful and they asked for the Boards support again this year.
Trustee Eydt asked if there was a controversy last year in collecting the donations.
Ms. Marasco said Artpark didn’t want them on their premises and they complied by using S Fourth & Tuscarora Street.
Mayor Geiben said now that they have been officially requested, they will discuss the proposal and maybe have a better idea for this year.
Trustee Craft said they may be able to coordinate with the Lions Club and the Lewiston Fire Company and split the proceeds.
He said he was meeting with the Lions Club and will discuss it with them.
Don Luce, Public Relations and Director of Community Missions thanked the Board for allowing them to operate last year and said they provide 65,000 meals and have 475 people in the shelter.
Mayor Geiben said the Lewiston residents are very generous.
John Ceretto, Niagara County Legislator said he met with Mayor Geiben, Trustee Craft, Town Superintendent Reiter, and David Lacki to brainstorm about the possibility of having a shuttle from Niagara Falls to Lewiston to Youngstown.
He said they would try the pilot this summer if funding is made available.
Trustee Craft said it would be a good start to service Lewiston & Youngstown but they want to service the entire area.
Mayor Geiben said it will promote the area and bring tourists to their shops, restaurants, etc.
He said it is not a trolley but a shuttle bus which will seat 40 people and they will determine where it stops and when it returns.
He said they are working on it.

REPORTS Chief Salada said they have had some changes in the Police Department.
He said the Police Dog is getting extra training at no additional cost to be an apprehensive dog.
He said there is a Police Commission Meeting on April 12, 2010.
Recreation Director Gittermann said the Recreation Birthday Party was a success and she is looking forward to the Spring Fling on May 2, 2010.
Trustee Eydt said the HPC/Planning Commission meeting was cancelled in March because there was no business for action.
He said the request to historically designate the Opera Hall was withdrawn because they felt it would be too restrictive.

DOG PARK A motion was made by Trustee Sutherland seconded by Trustee Eydt and passed unanimously to authorize the Mayor to sign an agreement between the Town and Village of Lewiston for the creation of a (1 ½ acre) “Dog Park” on the Lewiston Plateau to provide additional public space for visitors and residents to exercise their dogs.
FIRE CO A motion was made by Trustee Collesano seconded by Trustee Craft and passed unanimously to approve the membership of Sarah L. Hartman to the Lewiston Fire Co No 1.
RESO A motion was made by Trustee Geiben seconded by Trustee Collesano to adopt the following resolution:
RESOLVED: That the Village of Lewiston will submit to the Niagara River Greenway Commission a proposal for recommendation of the Village of Lewiston’s Piper Law Office Welcome Center Project Grant funding request.
The motion passed unanimously.
Mayor Geiben explained that Trustee Collesano’s committee will submit the $54,000 funding request for the restoration of the Piper Law Office Welcome Center to the Greenway Commission.
Trustee Sutherland said he spoke to the Rotary Club regarding their request for a Barbecue Festival and said they changed their request to use Academy Park instead of Lewiston Landing Waterfront Park.
He said they would like to have it during the Art Festival on August 14 & 15, 2010 and they will submit a plan for the event.
Mayor Geiben said there is a mud hole on the Niagara Street side of the street at the Museum and they have asked if they could get some parking spaces there.
Supt Meigs said he will dig it out and put in the parking spaces.
Trustee Craft asked if it will set a precedent if they do it for the Museum.
Mayor Geiben said it will not because it is Village right of way and they can improve the Village property.
Trustee Collesano said it is a public building and the parking spaces will enhance the area.
The Board directed Supt Meigs to proceed with the installation of parking spaces at the Museum.
Mayor Geiben said the liaisons to the organizations needs to be updated because of the new Trustees and submitted a list for their approval.
Supt Meigs said he had Brundage Plumbing come in to clear the grease out of the sewer lines because it was building up again.
Mayor Geiben asked if the heavy rains caused any problems.
Supt Meigs said “no”.
He said Town Sewer Treatment Plant Operator Lockhart said the Village is doing great on the I & I.
Engineer Marino said the sewer line replacement on Seneca Street should start soon but it will be a quick job.
Mayor Geiben said to have the next project ready.
He said he spoke to Town Supervisor Reiter who said they do not need full engineering plans to have it done.
Trustee Collesano said the renovation plans for the Piper Law Office are moving along and they have two contractors bidding on the chimney repairs.
He said they have volunteers lined up to help out.
Trustee Eydt asked if all the restaurants put grease traps in.
Supt Meigs said some did.
Clerk Treasurer Welch said she spoke to John Roberts at Apple Granny’s restaurant and he wants to put in a new grease trap, and also spoke to Becky at Mangia Cakes who will be installing a new grease trap at her new location on Center Street.
She said she told them to contact the Building Inspector.
Trustee Eydt said they need to re-inspect the restaurants to see if they are in compliance because it is not fair to the businesses who had grease traps installed.
He said the businesses need to keep maintenance records and have inspections to see if they are cleaning the traps regularly.
Supt Meigs he has to clean out the lines every six months because of the grease problem.
Attorney Grenga said he will contact the Niagara County Health Department regarding the grease traps and then he can send the businesses letters regarding the requirements.
Engineer SanGiacomo after they get a permit they need to keep a record on cleaning, and the Village has the right to check their records and do inspections.
Trustee Craft said it is unfair to the businesses who comply with the grease trap requirements and the others don’t.
Trustee Sutherland said they should give the businesses a date to comply.
Trustee Collesano said he agrees that some people have a hardship, but they need to get a handle on it.
Trustee Sutherland said he will contact the volunteers for the Piper Law Office Welcome Center when they need them.
He said right now they are evaluating the walls to see if they can save the original plaster walls.
He said it looks like they can just repair them.
He said they ordered roof shingles.
Clerk Treasurer Welch said she will call for the dumpster and asked where they wanted it.
Trustee Sutherland said on S 9th Street near the building.
He said the “Black Pearl” sailing ship has signed a three year contract and will be at the waterfront at the end of May.
He said Liberty Cruises and the Historical Association of Lewiston will share the cost.
Mayor Geiben said they will install signs regarding the days and times of operation from the dock.
Trustee Craft said he is working on photos for the Village website with Recreation Director Gittermann.
Mayor Geiben said the Messiah Lutheran Church is having a lunch on March 24, 2010 in conjunction with Kiwanis, Mt. St Mary’s, TOPS Markets, Apple Granny Restaurant, Lewiston Village Pub, Silver Sneakers and Niagara Health and Fitness to declare the Village as a “Blue Zone” to raise awareness about Diabetes.
Trustee Sutherland said there will be cooking demonstrations, a poster contest and exercise programs.
He said it is great for the community.
Mayor Geiben said he is meeting with Niagara Heritage and they will be discussing a linkage to National Parks.
He said Trustee Craft and Trustee Sutherland and he met with Richard Kessel, NYPA to discuss the impact the Power Authority has had in Lewiston.
He said the Village lost land and tax benefits and is looking for the Power Authority to give the Village something beneficial.
He said no promises were made.
Mayor Geiben said he will be out of town on April 5, 2010 and because of the special meetings he suggested they cancel the work session.
The Board agreed to cancel the work session on April 5, 2010.

Mayor Geiben called the meeting to order at 6:00 PM in the Municipal Building on the above date.
RES Michael Johnson said the parking lot in front of his apartment building is in the Village right of way and he has three elderly tenants and would like to install handicap parking signs for them.
He said other people park there and he needs it for his tenants.
He said there was an ambulance called for one of his tenants and they had to park on the street.
Mayor Geiben said the right of way is for public parking.
Mr. Johnson said he would like to have the signs for his mother and another tenant who are elderly and they need the parking space closest to the sidewalk.
Trustee Eydt asked if he could install a parking lot off S 7th Street.
Mayor Geiben said the owners of the Brockview Apartments improved the parking area on S 7th but it doesn’t mean they have sole use of it.
Trustee Collesano asked why not install “restricted parking” signs.
Clerk Treasurer Welch said the parking are in front of the apartment building may have been approved by the development plan and the parking area may be grandfathered for his apartment use only.
Mayor Geiben said the Village Clerk will research the development plan to see if the parking was included.
Trustee Eydt said if he installs handicap parking signs the tenants will need handicap parking permits to park there.
Mr. Johnson said maybe he will just put one sign.
Engineer Marino said NFP & Sons were the low bid and they have the required bonding and a good performance record.
He said he recommended they be awarded the bid.
He said they are a small company but the proposed project is small and they should be well equipped to handle it.
BID A motion was made by Trustee Eydt seconded by Trustee Craft and passed unanimously to award the bid for the award the bid to NFP & Sons in the amount of $60,750 for replacement of 355 ft of sewer line on Seneca Street between S 5th and Niagara Street
Mayor Geiben said Mr. LaDuca presented his proposal for the Village Directory Map which will have no cost to the Village.
CONTRACT A motion was made by Trustee Collesano seconded by Trustee Eydt and passed unanimously to authorize the Mayor to sign a contract with Michael LaDuca, The Corporate Jesters for the design of the Village Directory Map in the amount of $1540
EXEC SESS A motion was made by Trustee Eydt seconded by Trustee Craft and passed unanimously to schedule an Executive Session immediately following the meeting to discuss litigation.
John Ceretto, Niagara County Legislator introduced Rick Pope, Niagara County Refuse.
He explained that Mr. Pope is working on scheduling another electronics recycling, and drug disposal.
Mr. Pope said he will be dropping off more recycle bins to the Clerk’s Office for the Village residents also.
Legislator Ceretto said there will be another drop off on April 10, 2010 in Lockport and there will be more sites coming up.
Mr. Pope said if the public calls their office and makes an appointment they will take their materials.
Legislator Ceretto said the landfill used to be used for the old Harrison Radiator Plant and they use it now for the environmental waste.
Trustee Eydt asked when the Village will have another pick up.
Mr. Pope said they will coordinate something with Supt Meigs.
Mayor Geiben announced that the new revised Code Books are in and asked the Board to take a look at them.
Clerk Treasurer Welch explained that there will be a public hearing to adopt the Code with the changes.
Trustee Eydt thanked Clerk Treasurer Welch for all her input and said it has taken two years with meetings and input from the Planning Commission.
Mayor Geiben said Clerk Treasurer Welch has worked diligently on the Code and said she wasn’t allowed to retire.
A motion was made by Trustee Eydt seconded by Trustee Collesano and passed unanimously to approve a facility contract for the Kiwanis Club to hold their annual “Block of Dollars” on August 14, 2010 on Center and Portage Road from 8:00 AM to 6:00 PM.
Mayor Geiben said there is a Budget Meeting on March 29, 2010 at 4:15 PM.
Mayor Geiben said he received a request from Dan Hoolihan for the use of Academy Park or Lewiston Landing Park for a high school reunion and asked the Board for their input.
Trustee Craft said he would like more information.
Mayor Geiben asked Engineer Marino if they have plans for the next water sewer Relicensing Project.
Engineer Marino said they can be ready for the next project as soon as possible.
Mayor Geiben told Engineer Marino to talk to Engineer SanGiacomo and Supt Meigs to work out the project and the cost and would like the water and sewer lines to be done at the same time so they don’t have to dig up the street twice.
Mayor Geiben said Attorney Grenga and Clerk Treasurer Welch are working on the “Dog Park” lease agreement.
Mayor Geiben said the historical marker has been repaired and replaced at the Little Yellow House and thanked Trustee Collesano for commissioning Bob Schroeder to repairing the marker.

Justin LaDuca, Boy Scout Troop #855 lead the Pledge of Alligance.
He read a statement announcing the Boy Scouts 100th Anniversary and explained their role in the community.
Mayor Geiben thanked Justin for all their help with Earth Day Litter Clean Up , their annual Christmas Tree Sales, parades, and their participation in other various events in the community.
Justin also thanked Supt Meigs for the great job on the 5th Street ice rink which he is enjoying skating.

REPORTS Zoning Officer Conde said he has resolved the issues regarding the unregistered vehicles that he had sent violation notices to the owners.
Recreation Director Gittermann said Birds Niagara is bringing an Owl for the children to see on Wednesday, February 17, 2010; the Powerlifting Tournament is on Saturday, February 20, 2010; Kids Bingo, Everyones Birthday and the Recreation Sale are also coming up.
Building Inspector Candella said he issued $85,000 in building permits and collected $365 in fees.

RESOLVED: that the Village of Lewiston Board of Trustees requests State Aid from NYS Office of Children and Family Services for the 2010 program in the amount of $415 for Recreation and $376 for Youth Services for a total of $791 for the Lewiston Recreation Department.
DISC Michael LaDuca, Corporate Jesters, presented a plan for a directory sign to be placed in three locations in the Village.
He said it will have businesses, retail, restaurants, and professional services to advise people of the locations.
He said the businesses will pay for the advertisements on the sign and it will pay for the signs.
Mr. LaDuca said the sign will be approximately 40” x 30” and the Village DPW will construct the signs.
He said he will do the design for the directory and it will be under watertight glass.
He said the directory can be changed when new businesses open or old businesses close.
He said the cost is minimal with $1500 for the design and $50 for the artwork.
Trustee Craft asked if all the businesses will be on the directory.
He said there is a problem alerting people that there are businesses past Fourth Street and at the waterfront.
Mr. LaDuca said there will be a complete directory with all the businesses on it and a “you are here” spot.
Mayor Geiben said there will be a directory at the waterfront, half way on Center Street and at Academy Park.
He said they will place them over the electrical boxes on Center Street.
He said if they receive enough revenue they could do more.
Mayor Geiben said there will also be posters available to hang in the businesses.
Mr. LaDuca said the artwork will be produced digitally and can be made into any size.
He said it can be made into placemats also.
Trustee Craft said it would be beneficial to have one at the Chamber also.
He suggested they speak to the Chamber regarding the proposal to have their input.
Mayor Geiben said he already spoke to Chamber Director Lacki.
Trustee Craft said something like this is long overdue.
Mayor Geiben said he would like to have one at the Mini Plaza also.
Trustee Eydt asked who will be selling the ads.
Mayor Geiben said the Chamber will.
Trustee Sutherland said the Lewiston Queenston Rotary approached him and asked if the could hold a barbecue festival in Academy Park.
He said they filled out a facility contract and they would like to make it an annual event.
He said they would also use the Band Shell.
Trustee Collesano said if they have a beer tent they will need to control it, fence it, and get the necessary liquor permit.
FAC CONT A motion was made by Trustee Eydt, seconded by Trustee Craft and passed unanimously to approve a facility contract for the Lewiston Queenston Rotary to hold a Barbecue Festival on July 24 & 25, 2010 at Academy Park.
Trustee Sutherland said the Historical Association of Lewiston has offered to replace the existing plaque at Hennepin Park.
He said the plaque will be similar to the Freedom Crossing Plaque.
Following a brief discussion, a motion was made by Trustee Sutherland seconded by Trustee Eydt and passed unanimously to authorize the Historical Association of Lewiston to replace the plaque at Hennepin Park with a new plaque.
Trustee Sutherland said the Historical Association of Lewiston has contacted the owners of the “Black Pearl” tall ship to have them dock at Lewiston Landing and offer tour rides on the ship as a fundraising endeavor for the Historical Association.
He said the patrons would sail on the Lower Niagara River and visit various historic sites of interest.
Trustee Sutherland said the one hour tours would start May 29, 2010 and continue on Saturdays until the fall at a cost of $40.
He said the ship could be reserved on Sundays by private groups.
He said the Silo restaurant has graciously offered to sell the tickets from the “caboose” at Lewiston Landing Park.
He said the Historical Association is very excited about it.
Mayor Geiben said the Village will provide parking and moorings for the ship.
RESO A motion was made by Trustee Eydt seconded by Trustee Collesano and passed unanimously to adopt the following resolution to approve the use of Lewiston Landing dock for the mooring of the “Black Pearl”:
SUPPORT AND PERMIT FOR THE HISTORICAL ASSOCIATION
OF LEWISTON'S HISTORIC SAIL FUNDRAISING PROGRAM
Whereas: The Historical Association of Lewiston (HAL), Inc, a not
for profit 501(c)3 corporation, has preserved and promoted Lewiston's
rich heritage for the past 37 years, and
Whereas: HAL has has undertaken a number of fundraising activities
over the years to continue its valued mission, and
Whereas: HAL's next fundraising project is to provide Historic Sails
on the Lower Niagara River, on board the Brigantine Black Pearl, a
tall sailing ship, and
Whereas: Passengers aboard the Black Pearl will enjoy a one hour
ride and will see and experience a number of historical points of
interest, including where fugitive slaves crossed the river, where
the first battle of the War of 1812 was fought, where the first
railway in America was built, and where French explorers open the
Great Lakes to commerce, and
Whereas: HAL is in need of dock space for the Black Pearl, and
respectfully requests the Village of Lewiston to assist in its
fundraising project, and
Whereas: The dock space that is needed is directly below the Silo Restaurant,
SO THEREFORE BE IT RESOLVED: That the Village of Lewiston supports
the Historical Association of Lewiston's Historic Sail fundraiser,
and hereby permits the use of the Lewiston dock to sailing ships
commissioned as part of the fundraiser, and
BE IT FURTHER RESOLVED: That before the Black Pearl, or other
sailing ships, commence operations in Lewiston, that the ships'
owners provide proof of insurance and liability coverage, proof of
the ship's seaworthiness, and Master of Sail licenses from the U.S.
Coast Guard which permit the captains to take on passengers.
Trustee Collesano said they should have the Harbormaster advise the fishermen to move down from the area where the ship will be docking.
Mayor Geiben said the Village will install signage advising the public of the mooring space and parking.
Clerk Treasurer Welch announced that the new Code Books should be arriving this week.
Trustee Eydt commended Supt Meigs and the DPW for doing a great job snow plowing this winter.
Engineer Amico said the bids for the replacement of the sewer lines on Seneca Street are due on Friday.
Trustee Collesano said the Committee for the Historis Piper Law Office met and Eva Nicklas is doing the PR on the project.
Trustee Sutherland said he would like to thank Trustee Ron Winkley for his service to the Village and congratulated Trustee Ron Craft and said he looks forward to working with him.
Trustee Craft said he is happy to be on board.
He said Lewiston has come a long way and he feels they can do even better.
Mayor Geiben welcomed Trustee Craft and said he would also like to thank Trustee Winkley for his service.
He said Winkley will still be working with the Village because he is now a Town Councilman and so is former Trustee Mike Marra..
He said it is good having them on the Town Board because they can help with the Village’s needs also.
He said CPA Patrick Brown will be attending the next meeting to discuss the Village’s financial state, which is in good shape.
Mayor Geiben said he attended the BiNational Conference and they are looking forward to a War of 1812 celebration.
He said they have $45,000 to promote the event.
